A consumer complaint against advertising featured in Cell C’s in-store pamphlet and online about advertisement of R399 pm on a 24 month contract apple iphone 5 16GB. but ASA found Cell Advert is not misleading.
Consumer submitted complaint about Cell advertisement is misleading as the offered data is only for browsing. However, once you start downloading you are charged extra irrespective of how much of the allocated data is still left.
That includes:
- 100 any time minutes
- 100 monthly sms/mms
- 400MB monthly data
Cell C responded by blaming a technical error which led to the customer being charged when he was still within his 400MB. He has since been refunded.
The ASA concluded by declaring that Cell C advertisement is not actually misleading, but Cell C system incorrectly or erroneously implemented. This error created the impression that the Cell C was implementing its data charges in a manner that contradicted the advertising.
